Purchase terms

The PCT supplies among its suppliers in two modes of purchase the call to the competition and the direct agreement.

Call at competition:
Given the importance the drugs play in its global turnover, the company strives to play the maximum of competition in the purchase of these products.

This approach requires on the one hand that the drug has fallen in the public domain and on the other hand, there are at least two suppliers with a valid marketing approval in Tunisia (AMM) 
The two sectors, retail and hospital, are concerned by this approach which has the objective to optimize prices. Calls for tenders, as well national and international, are more important in volume and value in the hospital sector.

In the past the company had not to comply with the procedures of public procurement in its purchases in pharmaceutical products.

Indeed, as well Decree-Law of January 16, 1961, as law N ° 90-105 of 26 November 1990 told that markets or conventions concluded by the PCT are not subject to the regulation of public procurement in its purchases for sale in “the State” or after conditioning, in relation to her commercial activity".

However, the amendment made in 2007 on the provisions of the code of public contracts submitted markets whose value is the jurisdiction of the superior Commission of markets in the opinion of the latter.

Direct agreement:
This mode of purchase, also concerns, as well the retail sector as the hospital sector. The use of this mode of purchase is justified by a reality of the Tunisian market:
Low number of marketing approval for a given drug and
the pressure of patients, including prescribers.
